CITY ATTORNEY FEUER SECURES PRELIMINARY INJUNCTION AGAINST MEDICAL MARIJUANA DELIVERY APP MAKER
LOS ANGELES – City Attorney Mike Feuer today announced his office has successfully secured a preliminary injunction against the operators of NESTDROP, a smartphone application for medical marijuana delivery.
“This app is a flagrant attempt to circumvent the will of the voters who passed Prop D and we are pleased the court ordered NESTDROP to stop facilitating medical marijuana delivery,” said City Attorney Mike Feuer. “Prop D strikes a balance between the needs of patients and the desire of neighborhoods to regulate the proliferation of medical marijuana dispensaries. Prop D also provides that caregivers are able to transport medical marijuana to legitimate patients.”
Judge Robert H. O’Brien today granted the City’s request for a preliminary injunction against NESTDROP, a smartphone application that facilitates illegal medical marijuana delivery. The injunction will prohibit the operators of the app from facilitating deliveries of medical marijuana in the city and directs them to modify the app to remove any and all references to medical marijuana delivery in Los Angeles.
In the complaint filed on Dec. 2, 2014, the City Attorney is also seeking civil penalties against NESTDROP for violations of Proposition D and unfair business practices.
In the 17 months since Feuer took office he has closed 408 medical marijuana dispensaries, half of the operating dispensaries.
Feuer’s Office has filed over 200 criminal cases against 743 defendants including both the dispensary operators as well as the property owners. The City Attorney has also taken civil action including an injunction closing a popular medical marijuana farmers market in July.
Chief Deputy James Clark and Assistant City Attorney Asha Greenberg prosecuted the case.
